TERMS & CONDITIONS – PICNIC IN THE PARK FESTIVAL 2025 (“Campaign”)

Picnic In The Park Festival Experience (“Event”)

1. Event Date: 4th July 2025, 5th July 2025 & 6th July 2025.
2. Shoppers must RSVP the preferred Event Date via the link provided in the Invitation Letter within three (3) days from the redemption date stated in the Invitation Letter.
3. One (1) confirmation email will be sent to the registered email address upon RSVP.
4. One (1) confirmation email is only valid for the specified Event Date. Change of date is not allowed once it has been confirmed.
5. One (1) confirmation email for the Event is only applicable for the entry of four (4) person in one (1) Event Date. All four (4) person must be present at the event, at the same time upon registration.
6. One (1) confirmation email for the Event is only entitled to one (1) picnic spot, one (1) picnic basket with goodies (“Goodies Basket”) and food & beverages for four (4) pax.
7. Food provided in the Event must be consumed within five (5) hours upon receive.
8. The confirmation email and Goodies Basket is strictly non-resaleable, non-transferable and non-exchangeable for cash or other items.
9. Children aged twelve (12) and below must always be accompanied by an adult at all times during the Event. Children below the age of eight (8) years old are allowed in but should they exceed the 4 pax maximum, no additional food/goodies shall be given.
10. Outside food & beverages are not allowed into the Event except for infants or those who require special medical attention. Alcoholic drinks are strictly prohibited.
11. Pets or animals of any nature are strictly not allowed into the Event.
12. Smoking, vaping, use of electronic cigarettes, or any similar devices are strictly prohibited.
13. All trash, litter or refuse must be placed in the provided trash receptacles. No littering is allowed.
14. Suria KLCC Sdn Bhd (“Suria KLCC”) reserves the right to request for Shopper’s identification details and demand for proof of confirmation email for verification purposes.
15. Suria KLCC reserves the right to conduct any security searches and are allowed to confiscate any item which, in the reasonable opinion of the security agent acting on behalf of Suria KLCC, may cause danger or disruption to other Shoppers.
16. Suria KLCC will not be held responsible and liable for the food quality nor any food contamination.
17. Suria KLCC will not be held responsible for any loss or damage to the Goodies Basket, and no replacement or reimbursement is allowed.
18. Suria KLCC reserves the right to assign and change the seating arrangement at any time without prior notice whatsoever.
19. Suria KLCC reserves the right to refuse admission into the Event, ban from entry to the Event, or remove from the Event, any Shoppers who:
    1. Displays unruly, disruptive or offensive behaviour and profanity;
    2. Attempts to gain admission to the Event without a valid confirmation email or has been found inside the Event without a valid confirmation email;
    3. Displaces, make any alteration to, tears, removes, defaces or tampers with anything displayed, affixed, hung, placed or any other things exhibited at the Event;
    4. Climbs any wall, fence, structure or tree at the Event;
    5. Fishes, swims, bathes, touching of water, washes or dries anything in the fountain;
    6. Brings or consumes any intoxicating consumables at the Event;
    7. Spits, urinates or defecates in places other than the designated toilets for such purposes;
    8. Nails, ties, binds, chains, draws, scribbles, paints, sprays, marks, affixes, inscribes, displays, places or hangs anything on any tree, plant or structure at the Event;
    9. Bring any pets or animals of any nature into the Event;
    10. Bring bicycles, scooters, or similar items;
    11. Smoking (including of e-cigarettes, vape, or any similar devices) in the vicinity of the Event;
    12. Bring Items that are generally regarded as dangerous, offensive, and unsightly in nature by the security agent acting on behalf of Suria KLCC;
20. Suria KLCC will not be held responsible for any claims, demands, expenses, losses, stamp duties, fines, penalties, costs, damages, and all other liabilities of whatever nature of description as may be incurred or sustained by any Shopper.
21. Suria KLCC shall not be held responsible or liable for any delay or cancellation in Event to the extent such delay or failure is caused by:
    1. rain, storm, flood, fire, earthquake or other natural disasters;
    2. war, invasion, hostilities, terrorist threats or acts, riot, or other civil unrest or violence;
    3. any disease, epidemic or pandemic;
    4. embargoes or blockades;
    5. national or regional emergency;
    6. strikes, labor stoppages, or slowdowns or other industrial disturbances;
    7. any order or guidance from any governmental or quasi-governmental organization, including without limitation in regard to travel, public gatherings, or health and safety;
    8. disruptions in supply chains, hotel inventory, commercial air travel or other public transportation;
    9. other similar causes beyond the reasonable control of Suria KLCC.
22. Suria KLCC reserves the right to postpone, cancel or change the information and details of the Event without prior notice whatsoever.
23. Any misuse/ tampering/ forgery of the confirmation email or Goodies Basket may constitute an offence under the law and the offender shall be liable for prosecution.
24. In the event of any inconsistency or discrepancy between this Terms and Conditions and the contents of any marketing and / or promotional materials relating to this Event, this Terms and Conditions shall prevail.

General

1. Suria KLCC reserves the right to request for Shopper’s identification details and demand for proof of confirmation email for verification purposes.
2. By participating in the Event, Shoppers are deemed:
   1. to have read, understood and agreed to be bound by the terms and conditions stated herein (“Terms and Conditions”).
   2. to have consented to Suria KLCC to collect, record, hold, store, use and disclose their personal information for advertising, publicity, marketing, and communications purposes which are necessary or related to the participation in this Event.
   3. to have released Suria KLCC from any liability, losses, damages, and any kind of claims and actions in relation to this Event, including but not limited to those resulting from the acceptance, possession, use or misuse of the Goodies Basket.
   4. to have agreed that their photos or video clips may be used for current or future advertising and/or publicity in relation to this Event without any claim for payment nor compensation.
3. Suria KLCC reserves the right to withdraw, cancel, suspend, extend or terminate this Event earlier in whole or in part, or to vary, delete, or add any Terms and Conditions at any time at its absolute discretion. For the avoidance of doubt, any such cancellation, termination or suspension by Suria KLCC shall not give the Shoppers any right to claim compensation against Suria KLCC for any or all losses or damages suffered or incurred by the Shopper whether as a direct or indirect result of the act of cancellation, termination or suspension.
4. Suria KLCC reserves the right to change, amend, delete or add to these Terms and Conditions without prior notice at any time.
5. All Personal Data relating to the Event shall be governed and dealt with in accordance with the Personal Data Protection Act 2010 and all other relevant laws in Malaysia.
